Ohio State University Has Registered A Trademark For “THE”
Ohio State has officially continued the application process to trademark “THE,” according to attorney Josh Gerben.
According to attorney Josh Gerben, the USPTO initially rejected Ohio State’s trademark application for the word “THE” on Sept 11, 2019, for two reasons:
1. It was a “merely ornamental” trademark.
2. Marc Jacobs, the clothing brand, had filed an application for “THE” before them.
While the specifics of the settlement agreement were not released, USPTO records show that Ohio State University and Marc Jacobs agreed to share ownership of the word “THE.”
Yesterday marks OSU’s first move to continue with the application process since they first did in 2019.
